By accessing or using StudSpec ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

StudSpec is a construction project management platform designed for homeowners. The Service allows you to track decisions, photos, budgets, documents, contacts, meetings, and questions related to your home construction or renovation projects. Certain features are available only with paid subscription plans.

3. Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date. You must be at least 13 years old to use the Service.

4. Subscription & Billing

• Free Plan: Provides limited access to the Service at no charge, subject to usage limits.
• Paid Plans: Paid subscriptions are billed monthly or annually in advance. Prices are displayed on our pricing page and may change with 30 days' notice.
• Free Trials: Paid plans may include a free trial period. You will not be charged until the trial ends. Cancel before the trial expires to avoid charges.
• Cancellation: You may cancel your subscription at any time. Your access continues until the end of the current billing period. No partial refunds are provided for unused time.
• Refunds: We offer a 30-day money-back guarantee for first-time subscribers. Contact us within 30 days of your first payment for a full refund.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Interfere with or disrupt the Service or servers connected to the Service.
• Use automated means (bots, scrapers) to access the Service without our written permission.
• Resell or redistribute the Service without authorization.

6. Your Content

You retain ownership of all content you upload to the Service (photos, documents, text, etc.). By uploading content, you grant us a limited license to store, process, and display it as necessary to provide the Service. We do not claim ownership of your content and will not use it for purposes unrelated to providing the Service.

7. AI Features

Certain features use artificial intelligence to analyze photos, summarize notes, and answer questions. AI-generated content is provided as-is and may contain errors. You should not rely on AI output as professional advice. AI features process your data through third-party AI providers subject to their terms and privacy policies.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by StudSpec and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, StudSpec shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. StudSpec is not a substitute for professional construction, legal, or financial advice.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination. We will retain your data for 30 days after termination to allow for data export, after which it may be permanently deleted.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Texas.
